Q.01Is recreational cannabis legal in New York for visitors?
Yes. Adult-use cannabis has been legal in New York State since 2021 for anyone 21 or older. You do NOT need to be a New York resident to buy from a licensed dispensary — any valid government-issued photo ID works (out-of-state driver license, passport, military ID, foreign passport). The NY OCM regulates the program; Terp Bros NYC operates two CAURD-licensed stores in Queens.
Q.02Can I buy at Terp Bros if I just landed at JFK or LaGuardia?
Yes. Ozone Park (135-26 Cross Bay Blvd) is about 20 minutes from JFK via Conduit Blvd or the A train at Aqueduct-Racetrack. Astoria (36-10 Ditmars Blvd) is about 5 minutes from LaGuardia by car or the Q70 LaGuardia Link bus to the N/W Ditmars terminus. Bring your passport or out-of-state ID. Q.03How much can I buy as a visitor?
New York's adult-use purchase limit is 3 oz of flower (or equivalent) per visit. Edibles are capped at 10mg THC per serving and 100mg per package by state law. There is no separate visitor limit — the same rules apply to residents and tourists. Bring cash or a debit card; credit cards are not yet accepted at NY cannabis dispensaries due to federal banking restrictions.
Q.04Can I take cannabis on a plane back home?
No. Cannabis remains federally illegal, so it cannot legally cross state lines or fly on any aircraft (including domestic flights). TSA does not search for it specifically but is required to report it if found. Consumption is also prohibited in public, on the subway, in airports, in hotels (most chains ban it indoors), and within 100ft of a school. Enjoy it where it's legal to consume — your private rental, a private residence, or licensed consumption lounges if available.
Q.05Where can I actually consume in NYC as a tourist?
Private residences (including most short-term rentals if the host allows it) are the safest option. Hotels are typically off-limits — most major chains prohibit smoking of any kind indoors. Public consumption (parks, sidewalks, beaches) is illegal and risks a civil fine. NY has not yet licensed widespread consumption lounges. If your rental allows it, edibles and vapes are the easiest formats for travelers — discreet, no smoke, no smell.

Includes US state driver licenses (any state), US passports, foreign passports, US military IDs, US Green Card / Permanent Resident card, and tribal IDs. We do not accept paper IDs, expired IDs, or IDs without a photo. Bring it with you — you'll be checked at the door.
