Chapter 02

Is Cannabis Delivery Legal in Nassau County?

Yes. The Office of Cannabis Management's delivery FAQ says licensed retail dispensaries deliver to a customer 21 or older at a residence or private business "anywhere in New York State", and Nassau County is part of the state.

Local opt-outs are narrower. OCM's fact sheet for local governments says cities, towns and villages can opt out of retail dispensaries or on-site consumption licenses "from locating within their jurisdictions", and that "County governments are not permitted to opt-out of any adult-use license types." Deliveries still go only to a residence or private business, never to public spaces such as parks or to a car.
